2. FILING A DMCA INFRINGEMENT NOTICE
If you believe that your copyrighted work has been copied and made available on the Platform in a way that constitutes copyright infringement, send our Designated Agent a written notice that includes substantially the following:
- (1) A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- (2) Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
- (3) Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (for example, the URL of the listing or page where it appears).
- (4) Your contact information, including your name, postal address, telephone number, and, if available, an email address.
- (5) A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- (6) A statement that the information in the notice is accurate.
- (7) A statement, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Notices that do not substantially comply with Section 512(c)(3) of the DMCA may not be effective. Before filing, consider whether the use may be protected by fair use or another exception; KNOWING MATERIAL MISREPRESENTATIONS IN A NOTICE MAY EXPOSE YOU TO LIABILITY FOR DAMAGES, COSTS, AND ATTORNEYS' FEES UNDER SECTION 512(f) OF THE DMCA.
3. WHAT HAPPENS AFTER WE RECEIVE A NOTICE
Upon receipt of a substantially compliant notice, we act expeditiously to remove or disable access to the identified material, notify the user who posted it, and provide that user with a copy of the notice, which may include your name and contact details. We document notices for our records and repeat-infringer tracking.
4. FILING A COUNTER-NOTICE
If you believe material you posted was removed or disabled by mistake or misidentification, you may send our Designated Agent a written counter-notice that includes substantially the following:
- (1) Your physical or electronic signature.
- (2) Identification of the material that was removed or disabled and the location where it appeared before removal.
- (3) Your name, postal address, and telephone number.
- (4) A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- (5) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Hutfin may be found), and that you will accept service of process from the person who filed the original notice or that person's agent.
Upon receipt of a valid counter-notice, we forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in 10 to 14 business days after receipt of the counter-notice, at our discretion and consistent with law.
5. REPEAT INFRINGER POLICY
We maintain records of infringement notices. In appropriate circumstances, we disable or terminate the accounts of users who are subject to repeated, substantiated notices of infringement, and we may remove content or limit account features at our discretion whether or not infringement is repeated. Terminated users may not re-register without our written permission.
6. TRADEMARK AND OTHER INTELLECTUAL PROPERTY COMPLAINTS
Complaints regarding trademark infringement or other intellectual property violations on the Platform may also be sent to copyright@hutfin.com with the subject "IP Complaint," including identification of the right claimed, proof of ownership or authorization, the location of the challenged material, and your contact information. We review such complaints and take action we deem appropriate, which may include removal of content and account restrictions.
